OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN

Please read these Official Rules carefully before entering the 2013 Capital Region International Airport Mom’s Day Fly Away Travel Voucher Contest (“Contest”).  By entering the Contest, you agree that you have read, and are bound by, the terms and conditions set forth below as if you had signed a written contract.  If you do not agree to the terms and conditions set forth below, you may not enter the Contest. The Sponsor may modify the terms and conditions of these Official Rules as described below, and you agree to familiarize yourself with such modifications by reviewing the “Official Rules” posted on the Sponsor’s website (as defined herein).

SPONSOR/ADMINISTRATOR: The Capital Region Airport Authority (CRAA), 4100 Capital City Boulevard, Lansing, MI 48906 is the Sponsor of the Contest. CRAA and Pace and Partners, Inc., 1223 Turner St. #101, Lansing, MI  48906 are the Contest Administrators.

NO PURCHASE NECESSARY/VOID WHERE PROHIBITED:  No purchase is necessary to enter or win. This Contest is presented for the purpose of promoting the business of the Sponsors within the State of Michigan in accordance with MCL 750.372.  It is void where prohibited by law. 

ELIGIBILITY: Entry in the Contest is limited to legal residents of the State of Michigan who are at least 18 years of age or older (“Eligible Entrant”) and who comply fully with the entry requirements in these Official Rules.

Employees, directors and officers, and the immediate family members of employees of CRAA or Pace and Partners, Inc., and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and companies involved in the design, implementation and execution of the Contest (collectively, the “Contest Entities”) are not eligible.

DESCRIPTION OF THE CONTEST AND HOW TO ENTER:

A. Description of the Contest:  Eligible Entrants who fill out an Entry Form (“Entry Form”) and tell our Sponsor just what it is that makes their mom special will be eligible to win one (1) $1,000 voucher good for the purchase of air transportation anywhere in the continental United States.

B. How to Enter:  NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE.  Only Eligible Entrants may enter the Contest or win a Prize.  Entrants must complete the Official Entry Form telling what makes their mom special. There are three ways to enter the Contest: on-line, by mail, or in person at the Capital Region International Airport. 

1. On-line Entry:  To enter on-line, an Eligible Entrant must submit a completed entry form online at www.flylansing.com/mom (“Official Entry Form”) between 12:01 a.m., Eastern Time (“ET”) on Monday, April 1, 2013, and 11:59 p.m., ET on Friday, May 3, 2013 (the “Contest Period”). 

2. In-Person Entry:   Eligible Entrants who do not wish to enter on-line may enter in person at the Capital Region International Airport, Information Desk at 4100 Capital City Blvd., Lansing, MI 48906 during the Contest Period. 

3. Entry by Mail:  To enter by mail, an Eligible Entrant should complete an Official Entry Form (which is available on-line at www.flylansing.com/mom) and mail it to: “Mom’s Day Fly Away”, c/o Pace and Partners, Inc., 1223 Turner Street, Suite 101, Lansing, MI 48906.  Your entry must be postmarked no later than the close of the Contest Period.

C. Entry Requirements: All entries must be received on-line, in-person, or postmarked during the Contest Period, and all mail-in entries must be received by the Sponsors on or before Monday, May 3, 2013.  Entries received prior to, or after the Contest Period, are in violation of these Official Rules and are void.  Method of entry will not affect an Eligible Entrant’s opportunity to win the Grand Prize.  All entries must be: complete, legible, 150 words or less, contain no foul language or inappropriate material, and be the Eligible Entrant’s original work, and entries that violate these requirements or other provisions in these Official Rules will be void and the Entrant will be disqualified. Limit one entry per Eligible Entrant regardless of the method of entry.  Automated methods of entry are prohibited.  No copies, facsimiles or mechanical reproductions will be accepted.  Multiple entries in contravention of these Official Rules, or entries generated by a script, macro or other automated means, will be disqualified. Sponsor(s) is not responsible for lost, late, stolen, damaged, misdirected or illegible entries.  All entries become property of the Sponsors and will not be returned. 

HOW TO WIN THE CONTEST/JUDGING CRITERIA/JUDGING PROCESS:  Entries will be judged by contest jurors selected by the Sponsor who will review the entries of all Eligible Entrants.

A. Judges:  The sponsor has selected three (3) Primary Judges and (1) Alternate Judge. All Judges are employees of the Sponsor or Contest Entities.  The alternate judge will serve only in the event of a tie for the Grand Prize.

B. Judging Criteria:  The Judges will determine a Grand Prize Winner utilizing the following criteria and assigned weighting:

1. Originality of the Entry – the most unique, inspirational, or funniest. 30%
2. Creativity of the Entry – the most creative way of expressing theme. 30%
3. Relevance to the Theme – adherence to the theme of why the Eligible Entrant’s mom so special. 30%
4. Quality of the Entry and Compliance with the Official Rules - 10%

C. Judging Process:  The judges will meet at the conclusion of the Contest Period and will review each Contest Entry and select the Grand Prize Winner. In the event of a tie, the Alternate Judge will review only the tied entries and, based on the judging criteria stated herein, will select the Grand Prize Winner.    

THE GRAND PRIZE:  One (1) Grand Prize will be awarded in the Contest.  The Grand Prize will consist of one (1) $1,000 Travel Voucher.  The actual retail value (“ARV”) of the Grand Prize is $1,000. The Grand Prize will be provided by the Capital Region International Airport.  The Grand Prize will be awarded to the Winner (“Grand Prize Winner”) if all eligibility requirements are met within 90 days of receiving a signed and completed W-9 form and Affidavit of Eligibility/Liability & Public Release Form from the Grand Prize Winner.

Taxes or fees, if any, or associated expenses, including travel insurance, baggage fees, meals, or other expenses associated with the Grand Prize are the sole responsibility of the Grand Prize Winner. The Grand Prize is non-transferable and cannot be substituted, except that sponsors reserve the right, in its sole discretion, to substitute the Grand Prize with a prize of equal or greater value if the Grand Prize cannot be awarded as stated.

The Grand Prize Winner will be notified by email and by phone.  If the Grand Prize Winner cannot accept the Grand Prize in conformity with these Official Rules, the Grand Prize will be forfeited and, in the Sponsor’s sole discretion, shall be awarded to another Eligible Entrant selected by the Judges utilizing the Judging Criteria. 

ENTRANT’S PERSONAL INFORMATION:  Information collected from any Entrant is subject to CRAA’s Privacy Policy posted at www.flylansing.com. CRAA does not share your information with or sell it to affiliates or third parties.

PUBLICITY RELEASE: In order to collect the Grand Prize, the Grand Prize Winner agrees to provide their express written consent to the Sponsor to use the Prize Winner’s name and photograph, as well as the Entry without compensation, in any and all advertising and promotional materials, including the promotional website relating to the Contest, in all media, now known or hereafter discovered, including, but not limited to the World Wide Web, forever in perpetuity.  The Grand Prize Winner shall waive any right to notification, review or approval of any such use and will further agree to provide any additional written consent to any such as may be reasonably requested by the Sponsors. Entering the Contest gives CRAA all rights to use any Entrant’s Entry Photograph in any capacity without compensation.

CONDITIONS OF PARTICIPATION AND RELEASE: By entering and participating in the Contest, Eligible Entrants: (a) release the Contest Entities from any and all liability for any claims, costs, injuries, losses or damages of any kind, caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of any prize; and (b) acknowledge that the Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the Prize including, but not limited to, its quality or availability.

All Eligible Entrants, including the Grand Prize Winner agree that the Sponsors, the Contest Entities, and their respective parent or affiliated companies, subsidiaries, advertising and promotion agencies, and their respective officers, directors, employees and agents have no liability whatsoever for any injuries, losses or damages of any kind, including death, resulting from acceptance, possession, misuse or use of the Grand Prize including injuries associated with air travel or activities at the Grand Prize Winner’s travel destination.

The Grand Prize Winner and all Entrants in the Contest shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of his or her name, picture, likeness, address (city and state), e-mail address, biographical information, or Official Entry Form. The rights granted under this paragraph shall extend to Sponsors and the Contest Entities and their affiliated companies, agencies or marketing partners with respect to all Entrants in the Contest, including non-winners and the Grand Prize Winner.

SPONSOR’S RIGHT TO DISQUALIFY: Any attempt by a Contest Entrant or any other individual to tamper with the entry and/or selection process, or otherwise undermine the legitimate operation of the Contest may be in violation of criminal and civil laws, and the Sponsors’ reserve the right to cooperate in the prosecution of such individuals. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

If for any reason the Contest is not capable of being executed as planned, or unauthorized intervention, fraud, action of Entrants, technical failures or any other causes which, in the sole opinion of Sponsors, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor, in its sole discretion, reserves the right to disqualify any suspect entry or entrant, and to cancel, terminate, modify, or suspend the Contest.

DISPUTES/CHOICE OF LAW: The judges have the sole authority and responsibility, in their sole discretion, to select and/or recommend a Grand Prize Winner during the judging process. Any disputes concerning the construction, validity, interpretation of the rules, or the rights or obligations of the Judges, the Sponsor, or the Entrants, in connection with the rules, their enforceability, or interpretation, will be resolved by the Sponsor and all decisions of the Sponsor and/or the Judges shall be final and not subject to dispute or protest by any participant, or Eligible Entrant in the Contest.  Further, Eligible Entrants agree that:

1. Any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or the Grand Prize shall be resolved individually, without resort to any form of class action, and exclusively through binding arbitration to be held at or near Lansing, Michigan before a single arbitrator selected by mutual agreement of the parties, or, if the parties cannot agree, by selecting from a list provided by the American Arbitration Association; and

2.  Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event, attorneys’ fees; and

3.  Under no circumstances will an entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages (other than out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state of Michigan.
